Clerk's Duties

The Clerk's Office assists the Circuit Court Judges in the execution of their judicial duties by preparing, recording, and maintaining court orders, subpoenas, and pleadings. The Clerk's Office also manages the Court's docket and juries. Case-related information and court documents are provided to state, local, and federal agencies as well as to the general public, attorneys, litigants, and the media.

Grand Jury

The Grand Jury convenes once every two months to determine whether indictments should be certified as true bills and therefore tried in the Circuit Court. Docket call, where pending cases are set for trial, is also held every two months. Case delay reduction, the process of expeditiously bringing cases to trial or disposition, has been an on-going focus of the Court and Clerk's Office. Strict docket control efforts have created a more streamlined docket which allows for earlier trial dates and greater access to the courts by the public.

The Courts

The Criminal Division of the Circuit Court handles all felony cases as well as misdemeanor appeals from the General District and Juvenile and Domestic Relations District Courts. The Law Division handles writs, garnishments, and money and contract disputes. Circuit Court has exclusive original jurisdiction for all law cases exceeding $10,000. The Chancery Division handles equity suits (or those claims seeking judgment for something other than money) including divorce proceedings, property disputes, adoption proceedings, name changes, and appeals from Juvenile and Domestic Relations District Court (mainly regarding support, custody and visitation issues).

Additional Services

On the non-judicial side, the Clerk of the Circuit Court is the probate judge in admitting or denying wills to probate, in qualifying executors/administrators of estates, and in appointing guardians over the estates of minors and incompetents. The Clerk is also the County Registrar of Deeds and, as such, is responsible for recording all deeds, deeds of trust, powers of attorney, and real estate liens and releases. Other transactions and recordings processed by the Clerk's Office include judgments, financing statements, partnerships, fictitious names, marriage licenses, concealed weapon permits, and a variety of appointments including ministers, notaries, local Commission and Board members, and law enforcement officers.
