
Form Policy
Filing of Petitions for Domestic Relations Cases
It is the policy of this Court that all petitions filed with this court are to be submitted on the appropriate State form. Any petition submitted in a format other than a State form will be returned to the individual filing the petition with an explanation of the proper filing procedure and copies of the appropriate forms. When filing an original custody and a visitation petition (DC 511) or a motion to amend with the court a separate petition is required for each child and for each issue. An Affidavit (DC 620) must also be filed with any petition (original and motion to amend) for custody and visitation. Along with the petition three (3) additional copies of the petition must be submitted for each party to be served. The attorney may include a Notice for each party or the Court will prepare a Summons (DC 510) to be served.

Original Petition for Custody/Visitation (DC-511)
When used
This petition is used when there is no existing court order regarding custody or visitation.
Where to file
Attorneys with the Clerk's Office.
Citizens with the Intake Office of the Court Service Unit, (804) 501-4692.
How to file
Attorneys shall submit an original and two (2) copies of the petition on each child and on each issue (custody and visitation are separate issues). The attorney should also submit their avoid dates at that time.

Original Petition for Support (DC-610)
When used
This petition is used when there is no existing order regarding support.
Where to file
Attorneys with the Clerk's Office.

How to file
Attorneys shall submit an original and two (2) copies of the petition. The attorney should also submit their avoid dates at that time.

Motion to Amend or Review Order (DC-630)
When used
This petition is used when there is an existing order and the petitioner is requesting that it be changed or modified.
Where to file
Citizens and attorneys both file in the Clerk's Office.
How to file
Citizens may file an amending petition on Monday and Thursday between the hours of 8:30 AM and 4:00 PM. Attorneys shall submit an original and two (2) copies of the petition on each issue (custody and visitation are separate issues) and on each child. The attorney should also submit their avoid dates at that time.

Motion for Show Cause Summons (DC-635)
When used
This motion is used when there is a need to return someone to court for failing to abide by the condition(s) of a court order.
Where to file
Citizens and attorneys both file in the Clerk's Office.
How to file
Citizens may file a Motion for Show Cause on Monday and Thursday between the hours of 8:30 AM and 4:00 PM. Attorneys shall submit an original Motion for Show Cause to the Clerk³¹s Office. The attorney should also submit their avoid dates at that time.

Affidavit
When used
This form is used when filing an original petition of custody.

Attorneys shall submit an affidavit form for each child when filing an original petition for custody.

Request for Witness Subpoena (DC-325) (DC-497 Attorney Issued)
When used
Use this form when requesting witnesses to appear on your behalf.
Where to file
Citizens and attorneys should submit completed Request for Subpoena Witness forms to the Clerk's Office. Attorneys may also issue their own subpoenas for witnesses in civil matters after obtaining the court date from the Clerk's Office on line at http://www.courts.state.va.us/forms/home.html#aisupoenas.
How to file
In order to determine the proper case, all information needs to be completed along with who requested the subpoena. Rules of Virginia Supreme Court requires that this request be filed in the Clerk's Office at least ten (10) days prior to the trial date (Rule 8:13).

Subpoena Duces Tecum (Civil) (DC-336) (DC-498 Attorney Issued)
When used
This form is used to request that information be submitted to the court from a third party. This may include items such as payroll records, medical records, school records, etc.
Where to file
Citizens and attorneys should submit completed Subpoena Duces Tecum forms to the Clerk's Office. Attorneys may also issue their own subpoena duces tecum on line at http://www.courts.state.va.us/forms/home.html#aisupoenas.
How to file
Rules of Virginia Supreme Court require that a subpoena duces tecum to be filed in the Clerk's Office at least fifteen (15) days prior to the court hearing (Rule 8:13).

Motion to Rehear (DC-369)
When used
This form is used to request that the court rehear a matter.
Where to file
Citizens and attorneys should submit this motion to the Clerk's Office.
How to file
This motion must be submitted within 30 days after final disposition.

Order of Publication (DC-436)
When used
This form is used to place a notification in the newspaper in order to notify parties unable to be served notice, of an upcoming trial date, through the normal serving process.
Where to file
This request shall be filed with the Clerk's Office.
How to file
This request shall be filed at least fifty-two (52) days prior to the court date.

Order of Publication (DC-436)When used
These guidelines are used when one party has custody of the child. The court will determine the amount of support to be paid by the non-custodial parent by completing the guidelines in court in cases where there are no attorneys. In cases where attorneys represent the parties the attorneys should complete this form prior to the court hearing.

Child Support Guidelines Worksheet Split Custody (DC-638)
When used
These guidelines are used when physical custody resides with both parents. The court will determine the amount of support to be paid by the parties by completing the guidelines in court in cases where there are no attorneys. In cases where attorneys represent the parties the attorneys should complete this form prior to the court hearing.

Child Support Guidelines Worksheet Shared Custody (DC-640)
When used
In general these guidelines are used when a party has custody or visitation of a child or children for more than ninety (90) days of the year with "day" meaning a period of twenty-four (24) hours. The court will determine the amount of support to be paid by the parties by completing the guidelines in court in cases where there are no attorneys. In cases where the parties are represented by attorneys, the attorneys should complete this form prior to the court hearing.

Continuance Request Form
When used
The Continuance Request Form will be the vehicle through which the request for continuance will be reviewed.
Where to file
The Continuance Request Form should filed in the Clerk's Office at least two (2) weeks prior to the court hearing.

Motion and Notice of Proposed Income Deduction Order
When used
This form is used when requesting that support be made through a wage assignment that would be paid through the Division of Child Support Enforcement (DCSE).
Where to file
This form is filed with the Clerk's Office.
How to file
When filed notice will be given to the obligor who may contest the order by filing a written notice with the court within 10 days of the date of the issuance of the notice.

Request for Virginia Registration of Foreign Support Order
When used
This form is used when requesting the registration of a foreign support order (an order issued by an out of state court).
Where to file
This form is filed with the Clerk's Office.
How to file
When filed notice will be given to the nonregistering party that a hearing must be requested within twenty days after the notice to contest the validity or the enforcement of the registered order.

Request for Confidentiality Form
When used
This form is used when requesting that the court not release information to another party.
Where to file
This form is filed with the Clerk's Office.
How to file
This form is supplied to a victim of a crime or to a petitioner for support when the victim or petitioner wishes to request that the court not release any information regarding the victim or petitioner's residential address, telephone number, place of employment or family members.
