Responsible Land Disturber Program

In July 2001, Virginia implemented the Responsible Land Disturber (RLD) Certificate of Competence Program. This program requires that before an Erosion and Sediment Control (ESC) plan can be approved in Virginia, the project must have an RLD that is certified through the Virginia Department of Conservation and Recreation.

Who is considered an RLD?

A person who holds a:

• DCR RLD Certificate
• DCR Inspector, Plan Reviewer, Combined Administrator or Contractor Certificate
• Virginia Professional Engineer, Land Surveyor, Landscape Architect or Architect License

What are the responsibilities of the RLD on a project in Henrico County?

1) Attend the Pre-Construction meeting and sign the approved plans.

2) Inspect the erosion and sediment control measures periodically:

• At least once every two weeks or
• After a rain event

3) Maintain inspection reports on the site.

The inspection report will either:

• List all deficiencies in detail or
• State no deficiencies were found

4) Make inspection reports available for review by the Environmental Inspector:

• At the Office trailer
• In a mail box on site
• Fax
• E-Mail

Coordinate with the environmental inspector of the project at the Pre-Construction Meeting as to how the RLD of your project will make the required inspection reports available to the inspector.

It is very important that the inspection reports are filled out properly and completely.

The inspection reports will be treated much like a required erosion and sediment control measure.

If inspection reports are filled out incorrectly or not filled out at all, a Notice to Comply with be issued.

If inspection reports continue to be filled out incorrectly or not at all, a Stop Work Order will be issued and the RLD will be referred to DCR. DCR may suspend or revoke the RLD Certificate.
