Subdivision of land is regulated by the Henrico County Subdivision Ordinance and requires that a subdivision be recorded whenever a lot, tract, or parcel of land is divided into three or more lots or for the building or creation of a public road.

 

Action on subdivision plans are taken by the County Planning Commission at public meetings as a part of the overall review process.

What process is required to obtain subdivision approval?

The approval is a two step process:

  • Conditional Approval
  • Final Approval

 

BUT, before formally submitting the necessary documents for subdivision approval, it is suggested that you call or visit the Planning Department and review your proposal to determine the particular requirements for your project.

A conditional request is submitted to the Planning Department by the applicant with the following information:

  • Application form with check list completely filled out.
  • Fourteen (14) prints of the proposed subdivision plats.
  • Filing fee (amount determined by the number of lots submitted).

 

 

 

The Conditional request is then reviewed by the members of the County staff for compliance with County standards and regulations. The applicant and/or his representative meet with the County staff to discuss any comments, after which the Planning Department staff prepares a report and recommendation for transmittal to the Planning Commission.

The Planning Commission reviews the request at a public hearing at which time the Planning staff presents each proposal. After hearing information concerning the proposal, the Planning Commission may take action in one of four ways: grant approval of the request, grant approval of the request with recommended changes or conditions, deny approval of request, or defer hearing of the request for further review.

If the request is approved, the applicant has a period of twelve months in which to apply for final approval.

 

A request for final approval is submitted to the Planning Department by the applicant with the following information:

  • Application form with check list completely filled out.
  • Fourteen (14) prints of the final plats.
  • Five (5) sets of detailed construction plans prepared by a professional engineer or certified surveyor detailing the construction of required improve-ments.
  • Filing fee (amount determined by the number of lots submitted).

 

 

The Final approval request is reviewed by the staff and comments provided to the applicant. If the Final request is approved by the Director of Planning, the applicant has a period of one year in which to record the subdivision. Should the applicant be unable to request final approval or record the subdivision plats within the required time period, a written request for an extension of conditional or final approval may be submitted to the Planning Department for consideration by the Planning Commission.

In order to record the subdivision, the applicant must submit two (2) white opaque mylars and one (1) reproducible mylar to the Planning Department for a final review and approval signatures. The public improvements in each subdivision must be financially guaranteed to be constructed. After the improvements are constructed or the guarantee is accepted by the County, the applicant records his subdivision plats with the Circuit Court Clerk’s Office.

After the subdivision plats are recorded, the developer may submit plans for building permit approval.
